1. Pre-Order Terms and Kickstarter Campaign

1.1 Pre-Order Nature

PawPulse collars and services are currently available for pre-order. This is not an immediate purchase. By placing a pre-order, you understand and agree that:

• Products are in development and have not yet been manufactured at scale
• Estimated delivery is spring 2027, pending certification and production validation
• Final product specifications may differ from current descriptions
• Delays may occur due to manufacturing, supply chain, or unforeseen circumstances
• There is inherent risk in pre-ordering innovative hardware products

1.2 Funding and Development

PawPulse is an early-stage hardware company. Product development and manufacturing are funded through:

• Pre-order revenue (Kickstarter and direct sales)
• Small Business Administration (SBA) loans
• Government grants
• Potential venture capital funding

By placing a pre-order, you acknowledge that you are supporting the development of a new product and accept the associated risks, including the possibility of delays or cancellation.

1.3 No Guarantee of Delivery Date

While we strive to meet our estimated spring 2027 delivery window, we cannot guarantee specific delivery dates. Factors beyond our control (certification, production validation, supply chain issues, regulatory delays, or technical challenges) may impact timing. We will communicate updates proactively if delays occur.

2. Pricing and Payment

2.1 Pre-Order Pricing

Kickstarter reward pricing will be announced closer to the CES 2027 campaign launch. Prices are subject to change for future orders but will not change for confirmed pre-orders or confirmed campaign pledges.

2.2 Payment Processing

Payments are currently processed via third-party payment processors (Stripe, when implemented). By providing payment information, you authorize us to charge the full amount at the time of pre-order placement.

2.3 Subscription Services

Some PawPulse experiences require an ongoing plan for connectivity or cloud services. Product-specific plan details and final reward pricing are disclosed on the pricing surfaces in effect at the time of purchase, and billing begins when the relevant service starts rather than at pre-order.

3. Product Warranty and Limitations

3.1 Limited Warranty

PawPulse collars come with a 1-year limited warranty from the date of delivery, covering:

• Manufacturing defects
• Hardware malfunctions under normal use
• Battery defects

3.2 Warranty Exclusions

The warranty does NOT cover:

• Damage from misuse, abuse, or neglect
• Water damage if device is not certified water-resistant at delivery
• Normal wear and tear (scratches, cosmetic damage)
• Damage from unauthorized modifications or repairs
• Loss or theft of the device
• Software bugs (we provide free firmware updates to address issues)

3.3 Remedy

Our sole obligation under this warranty is to repair or replace defective products at our discretion. We do not provide refunds for products outside the 30-day return window (see Refund Policy).

4. Disclaimer of Warranties

EXCEPT FOR THE EXPRESS LIMITED WARRANTY STATED ABOVE, PAWPULSE PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

We disclaim all implied warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy of health monitoring data

PawPulse is NOT a medical device. Health monitoring features are for informational purposes only and should not replace professional veterinary care. Always consult a licensed veterinarian for medical decisions.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWPULSE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage arising from use of our products
• Veterinary expenses or costs related to pet health issues
• Emotional distress or loss of companionship

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE.

Some jurisdictions do not allow limitation of liability for personal injury or incidental damages, so these limitations may not apply to you.

6. Intellectual Property

6.1 Ownership

All intellectual property rights in PawPulse products, services, software, website content, trademarks, and proprietary technology (including patents pending) are owned by PawPulse Inc.

6.2 License

We grant you a limited, non-exclusive, non-transferable license to use our products and services for personal, non-commercial purposes. You may not:

• Reverse engineer, decompile, or disassemble our products
• Remove or modify any proprietary notices
• Use our trademarks without written permission
• Resell or redistribute our software or services

7. User Responsibilities

You agree to:

• Provide accurate and current information when placing orders
• Use products only as intended and according to user manuals
• Not use products for illegal purposes
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations
• Not interfere with or disrupt our services

8. Dispute Resolution and Governing Law

8.1 Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.

8.2 Small Claims Court

Any disputes arising from these Terms or your use of PawPulse products/services shall be resolved in small claims court in Clark County, Nevada, or through informal negotiation.

8.3 Waiver of Class Actions

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative proceedings.

9. Termination

We reserve the right to suspend or terminate your access to our services if you violate these Terms. You may terminate your account at any time by contacting us. Termination does not affect your pre-order obligations or warranty rights for delivered products.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or website notice. Continued use of our services after changes constitutes acceptance of the updated Terms. Changes do not apply retroactively to pre-orders placed before the update.

11. Miscellaneous

11.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PawPulse.

11.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

11.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

11.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations to a successor or affiliate.
