1. Eligibility
- You must be at least 18 years old to create a PawPulse App account.
- Social features and Prism AI are available only to users 18 and older. We ask you to confirm your age before you can use them.
- The App is not directed to children, and we do not knowingly allow anyone under 18 to hold an account. If we learn that an account belongs to someone under 18, we will close it and delete its data.
- You may not use the App if you are barred from doing so under applicable law or if we have previously banned you.
2. License Grant and Restrictions
We grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the App on devices you own or control, for your personal, non-commercial use, and as permitted by the usage rules of the app store you downloaded it from. The App is licensed, not sold. You may not:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App, except where the law expressly allows it
- Rent, lease, sell, sublicense, or redistribute the App
- Remove or change any proprietary notices
- Use the App to build a competing product or to train machine learning models
3. Your Account
Keep your login details private and tell us promptly if you believe someone else has accessed your account. You are responsible for activity under your account. Give accurate information, including your age.
4. Social Features and Audiences
Social features let you share posts, photos, comments, and reactions about your pets. You must accept this EULA and confirm that you are 18 or older before you can post, comment, or set up a Social profile. Each post has an audience:
- Family Only: the default. Only the family members you have added can see the post.
- Followers: people who follow you can see the post.
- Public: anyone using PawPulse Social can see the post.
Choose your audience carefully. People who can see your content may screenshot or share it outside the App, and we cannot control copies made that way. Leaderboards that show your city are opt-in and use city-level location only.
5. Zero Tolerance for Objectionable Content and Abusive Users
PawPulse has zero tolerance for objectionable content and abusive users. These rules apply to everything you share in the App, including posts, photos, comments, profile names and photos, pet profiles, and anything you ask Prism AI to produce. You may not post, send, or share content, or act in a way, that:
- Harasses, bullies, threatens, stalks, or intimidates anyone
- Is hateful or discriminatory based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or similar characteristics
- Is sexually explicit, pornographic, or sexualizes minors in any way
- Shows, promotes, or glorifies animal cruelty, animal fighting, or harm to people or animals
- Promotes self-harm, suicide, or violent extremism
- Is graphic or gratuitously violent or gory
- Promotes illegal activity, including the illegal sale of animals, drugs, or weapons
- Is spam, a scam, misleading, or impersonates another person or organization
- Shares someone else's private information, such as a home address or phone number, without permission
- Infringes someone else's copyright, trademark, privacy, or other rights
- Offers veterinary diagnosis or treatment claims presented as professional advice
Post only content you created or have the right to share. Use the App only for its intended purpose of sharing and caring for your pets.
6. Reporting, Blocking, and Our 24-Hour Commitment
- Report Content: tap the menu on any post, comment, or profile and choose Report. Pick a reason and submit. Reports are confidential; we do not tell the other user who reported them.
- Block Users: tap the menu on a profile or post and choose Block. A blocked user can no longer see your posts or interact with you, and their content is hidden from you right away. You can unblock people in Settings.
- Report an AI Answer: tap the menu on any Prism AI answer and choose Report if it is harmful, offensive, or wrong. We use these reports to improve Prism AI safeguards.
- Email Us: you can also report content, users, or AI answers at hello@pawpulse.ai. Include a link or description of the content.
We review reports and act on them within 24 hours. When content violates this EULA, we remove it and take action against the user who posted it, up to and including a permanent ban. We may also hide reported content while we review it. We use automated moderation to screen post text and images, and our team reviews reported comments, profiles, and other content. Automated tools miss things, so your reports matter.
7. Enforcement: Removal, Suspension, and Bans
We may, at our discretion and without prior notice, remove or restrict any content and suspend or permanently ban any account that violates this EULA, harms other users or animals, or creates legal risk for PawPulse. Banned users may not create new accounts. Where the law requires it, or where we think it is appropriate, we may report content to law enforcement, including reporting child sexual abuse material to the National Center for Missing and Exploited Children. If you think we made a mistake, email hello@pawpulse.ai with the subject line "Moderation Appeal" and we will take another look. We do not promise to monitor all content, and we are not responsible for content posted by other users.
8. Your Content and the License You Give Us
You keep ownership of the posts, photos, comments, and other content you share ("Your Content"). You grant PawPulse a worldwide, non-exclusive, royalty-free license to host, store, copy, process, resize, display, and distribute Your Content only as needed to run the App, show it to the audience you choose, moderate it, and keep the service safe. This license ends when you delete Your Content or your account, except for copies kept in backups for a limited time, content others have already reshared within the App as the feature allows, and records we must keep for legal or safety reasons. We will not use Your Content in advertising without your permission.
You are responsible for Your Content and confirm that you have the rights needed to share it and that it follows this EULA.
9. Prism AI
- Prism AI is a chat assistant for general pet wellness questions. It is available only to users 18 and older.
- Before your first use, we show you what Prism AI shares and ask for your consent. To answer, Prism AI sends your question, recent messages in the conversation, and a summary of your pet's wellness data to OpenAI, our AI provider, as described in our Privacy Policy.
- Prism AI has safeguards designed to refuse harmful or restricted requests, but they are not perfect. Report any answer that gets through.
- AI answers can be wrong, incomplete, or out of date. They are generated automatically, are not reviewed by a person, and are not veterinary advice. Do not rely on Prism AI to decide whether your pet needs care.
- Do not enter sensitive personal information, such as financial, government ID, or health information about people, into Prism AI.
- You may not use Prism AI to create content that breaks Section 5, to get around its safeguards, or to extract its prompts or models.
10. Wellness Only: Not Veterinary Advice
PawPulse is a consumer pet wellness product. It is not a medical device and does not diagnose, treat, cure, or prevent any disease or condition. Wellness insights, trends, alerts, Pulse Rhythm sessions, and Prism AI answers are for general information only and are not a substitute for care from a licensed veterinarian. If you think your pet is sick, injured, or in distress, contact your veterinarian or an emergency animal hospital right away. Do not delay care because of anything shown in the App.
11. Acceptable Use of the Service
You may not:
- Scrape, crawl, or collect data from the App or other users by automated means
- Interfere with, overload, or try to gain unauthorized access to the App, our servers, or other accounts
- Upload malware or harmful code
- Use the App to track, monitor, or locate a person without their consent
- Get around blocks, bans, age checks, rate limits, or moderation
- Use the App in violation of any law
12. Privacy
Our Privacy Policy explains what the App collects, including social content, moderation, Prism AI, and usage analytics, and the choices you have. You can delete your account in the App, which deletes your posts, media, AI conversations, and usage events as the Privacy Policy describes.
13. Updates, Changes, and Third-Party Services
We may update, change, or stop offering features of the App at any time. Some updates may be required to keep using the App. The App relies on third-party services, such as app stores, cloud hosting, and AI providers, and your use of those services may also be subject to their terms.
14. Termination
You may stop using the App and delete your account at any time. This EULA and your license end automatically if you break it, and we may end them at any time under Section 7. When the license ends, you must stop using and delete the App. Sections 8 (for content already shared), 10, 15, 16, and 18 survive termination.
15. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of wellness data or AI answers. We do not promise that the App will be uninterrupted, error-free, or secure.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWPULSE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, or for veterinary costs, loss of data, or content posted by other users, arising from your use of the App. Our total liability for any claim about the App will not exceed the greater of the amount you paid for the App in the 12 months before the claim or 50 US dollars. Some jurisdictions do not allow these limits, so they may not fully apply to you.
17. App Store Terms
If you downloaded the App from the Apple App Store, you and PawPulse also agree that:
- This EULA is between you and PawPulse only, not Apple. PawPulse, not Apple, is solely responsible for the App and its content.
- Your license is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts linked to you through Family Sharing.
- PawPulse, not Apple, is solely responsible for maintenance and support of the App. Apple has no obligation to provide any maintenance or support.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- PawPulse, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If a third party claims that the App or your use of it infringes their intellectual property rights, PawPulse, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms, such as your wireless data service agreement, when using the App.
- Apple and its subsidiaries are third-party beneficiaries of this EULA and, once you accept it, may enforce it against you.
If you downloaded the App from Google Play, the Google Play Terms of Service also apply to your download. If those terms conflict with this EULA about your relationship with PawPulse, this EULA controls.
18. Governing Law and Venue
This EULA is governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Exclusive venue for disputes about the App is in the state and federal courts located in Clark County, Nevada, unless the law of the place where you live gives you the right to bring a claim somewhere else.
19. Changes to This EULA
We may update this EULA from time to time. We will post the new version here with a new last-updated date and, for material changes, tell you in the App or by email before they take effect. If you keep using the App after changes take effect, you accept the updated EULA.
20. General
If any part of this EULA is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign this EULA; we may assign it to a successor or affiliate. This EULA, the Terms & Conditions, and the Privacy Policy are the entire agreement between you and PawPulse about the App.
